海商法海商法maritimelaw调整海上输中船、货各方有关当事人间权利、义务关系的法律规范的总称。海指海洋及与海相通的江、河、湖等水域；商指国内海上贸易及国际远洋贸易；海商法主要调整商船海事（海上事故）纠纷，但若发生海上船舶碰撞，则军舰、渔船、游艇等船舶以及水上飞机都在海商法调整范围之内。海商法的内容相当广泛。主要有：船舶的取得、登记、管理，船员的调度、职责、权利和义务，客货的运送，船舶的租赁、碰撞与拖带，海上救助，共同海损，海上保险等。海商法属于国内民事法律，在民商法分立的国家属于商法范畴；但为解决国际通航贸易中的船货纠纷，多年来已签订了许多国际公约和规则，主要有：《统一提单若干法律规则的国际公约》（即《海牙规则》，1968年修订称《维斯比规则》）、《联合国海上货物运输公约》（简称《汉堡规则》）、《统一有关海上救助的若干法律规则的公约》、《国际海上避碰规则》、《约克-安特卫普规则》、《防止海上油污国际公约》。它们分别对承运货物的权利和义务、责任豁免、海上船舶碰撞、海上救助、共同海损等作了详细规定。中国于1992年11月7日通过了《中华人民共和国海商法》，1993年7月1日施行共15章，主要内容有：①适用范围为调整海上运输关系和船舶关系。海上运输是指海上货物运输和海上旅客运输，包括海江之间、江海之间的直达运输。但海上货物运输合同的规定，不适用于中华人民共和国港口之间的海上货物运输。船舶是指海船和其他海上移动式装置，但是用于军事的、政府公务的船舶和20总吨以下的小型船艇除外。船舶包括船舶属具。②详细规定了海上货物运输合同、海上旅客运输合同、船舶租用合同、海上拖航合同、海上保险合同的成立，双方当事人的权利义务，违约责任等。③实行海事赔偿责任限制原则，即船舶所有人、救助人，可依法规定限制赔偿责任。该法还规定“中华人民共和国缔结或者参加的国际条约同本法有不同规定的，适用国际条约的规定；但是，中华人民共和国声明保留的条款除外。中华人民共和国法律和中华人民共和国缔结或者参加的国际条约没有规定的，可以适用国际惯例”。
