实际承运人实际承运人(ACTUALCARRIER)：掌握运输工具并参与集装箱运输的承运人。通常拥有大量集装箱，以利于集装箱的周转、调拨、管理以及集装箱与车船机的衔接。指根据缔约承运人的授权，履行全部或部分航空运输合同任务的人。缔约承运人授权实际承运人履行航空运输，一般不采用书面形式，因此实际承运人参与履行全部或部分运输的事实，构成缔约承运人授权的初步证据。在没有相反证明时，该事实即表现此种授权是存在的。实际承运人虽然是根据缔约承运人的授权履行全部或部分运输，但他不同于代理人。代理人是以授权人或委托人的名义行事，实际承运人是以自己的名义履行他人所订立的合同。代理人在代理范围内的行为，除故意行为外，其结果由授权人或委托人承担责任；实际承运人在授权范围内的行为，其结果由本人承担责任。
