行政执法国家行政机关按照法律法规对管理相对人采取的直接影响其权利义务，或对管理相对人权利义务的行使和履行情况直接进行监督检查的行政行为。它是行政机关重要职能之一。狭义上讲，行政执法指公安、工商、审计、海关、税务、物价等少数行政部门的工作。特点 主要表现为：①行政执法是行政机关执行法律法规的具体行为。行政执法使法律法规在实际生活中产生法律效果。②行政执法是行政机关直接同管理相对人之间形成法律关系的行为。这种法律关系是因行政机关主动行使行政权力而发生的。③行政执法一般对管理相对人的权利义务直接产生影响。管理相对人对执法行为不满或不服时，可以提请行政复议或提起行政诉讼。行政执法是行政机关最主要的行为。行政立法要通过执行才能生效。执法的结果如影响公民的合法权益，就会引起行政诉讼与行政司法。行政执法是行政立法的延续，又是行政司法的前提。在法律法规日趋完善的情况下，行政执法是行政管理中的决定性环节。主要表现形式 通常采取：①行政监督检查。为了实现行政职能，行政机关监督检查管理相对人行使权利和履行义务的情况。②行政处理决定。行政执法一般通过行政处理决定的形式表现。关于权利的决定可分为奖励性和非奖励性。奖励性行政决定是行政机关对遵守法律法规、完成任务作出贡献的组织和个人给予的精神和物质鼓励。非奖励性行政决定是指行政机关赋予公民以一般权利和权能的处理决定，其中以行政许可比较突出。关于义务的决定可以分为惩戒性和非惩戒性。惩戒性行政决定主要是行政处罚。非惩戒性行政决定是对公民科以诸如纳税等一般义务的处理。③行政强制执行。在行政管理中行政机关对不履行法定义务的当事人，用强制措施迫使其履行义务。羁束行政执法与自由裁量行政执法 行政执法行为因受法律拘束的程度不同而分为羁束行政执法与自由裁量行政执法。羁束行政执法是法律法规对需执行的事项有明确、具体的规定，执法者必须严格按法律法规的规定执行，没有自由处置的执法行为；自由裁量行政执法在法律法规规定中，执法者可在范围、方式、数额等方面有一定的选择余地的执法行为。羁束与自由裁量是相对的，如征收个人所得税的条件与税额一般都没有伸缩余地,治安管理处罚却有一定的幅度,可供行政机关自由裁量。但后者较之那种"可以处罚"而无任何种类、幅度的规定，显然又属于羁束执法。行政执法在多数情况下都属自由裁量。自由裁量也必须根据法律法规的授权和在法定的幅度以内进行,否则行政执法将无所适从,因执法而引起的行政诉讼也难以裁判。如何使行政行为既受法律的约束,又有根据具体情况作出处置的主动权,是行政法学研究的重要任务之一。行政执法的生效、撤销、变更和终止 行政执法的生效要件：行政执法行为必须是依法组成的并享有管理权限的行政机关在法定范围内采取的，执法内容必须合法；在行政执法中，管理相对人必须具有法定的权利和行为能力；行政执法的标的物必须是依法能作为该执法行为的物品；行政执法行为必须符合法定程序和法定形式。已经成立的行政执法行为，如发现其违法、不当或不再适应新的情况，可由有权机关撤销，宣布无效或不再生效。部分内容应予撤销，部分内容继续有效的，可以宣布保留其整体而变更其应撤销部分，对应变更部分作出新的决定。行政执法行为已执行完毕，或执行的条件已不复存在，或有期限的行政执法行为已到期，应宣布该执法行为终止。
